An arbitrator with the National Arbitration Forum has awarded the domain name FacebookLive.com to Facebook.Facebook submitted a complaint to the National Arbitration Forum on November 8,2011,asserting legal rights over the disputed domain name.

Facebook owns many trademark registrations for the “Facebook” mark.Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark.Moreover,Facebook contended that the respondent registered and used the disputed domain name in bad faith .

“Respondent’s disputed domain name resolves to a Parked website offering links to unrelated third-party businesses.  Respondent presumably generates revenue each time an Internet user is diverted through its website to one of the linked sites.  The Panel finds that Respondent is attempting to create confusion by using Complainant’s FACEBOOK mark in its domain name to divert Internet users to the linked websites, thereby collecting click-through fees.  “

The Panel ordered FacebookLive.com domain name to be transferred from the respondent to the complainant .
