
The domain name Quirk.com was just hit with a UDRP.The complaint was filed with the National Arbitration Forum.According to whois records,the domain is registered to TobyClements.com,LLC .
According to TobyClements.com,LLC they do not own Quirk.com.They changed the ownership to market the domain and Quirk.com is still owner by Exotic Design Group since at least 2005 .
Book Soup Publishing filed the complaint with the National Arbitration Forum on May 15,2013.
The National Arbitration Forum will examine if the domain name is confusingly similar to the trademarked name.Moreover,it will examine if the owner of the disputed domain name has rights over it and if the domain is being used in bad faith.The domain name will be passed over to Book Soup Publishing if it falls under all three of these stipulations.
The case is still pending compliance checks with the National Arbitration Forum .
The Toronto-Dominion Bank appears to have emerged victourius from a dispute regarding the domain TDWaterHouse.xxx .
The Toronto-Dominion Bank filed a complaint with the National Arbitration Forum on April 9, 2013 ,asserting legal rights over the disputed domain name TDWaterHouse.xxx .
The company owns a trademark registration for “TD Waterhouse” and is commonly known as TD for more than 100 years.Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark .
The Toronto-Dominion Bank has also managed to demonstrate the the respondent has no rights or legitimate interests in respect of the domain and that the domain has been registered and is being used in bad faith .
Having established all three elements ,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
