
According to whois records Borcelik.xxx was registered on December 9,2011,three days after the ICM Registry made the .XXX extension available for public sale.
Borcelik company submitted the complaint with the WIPO Arbitration and Mediation Center on January 18,2012,asserting legal rights over the disputed domain name.
Borcelik owns many trademark registrations for the “Borcelik” mark.Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark.Moreover,the company contended that the responded registered and used the disputed domain name in bad faith :
“Respondent must have known this trademark when the disputed domain name was created on December 9, 2011.
This assessment is in particular likely as the disputed domain name was registered many years after the Complainant’s trademark BORÇELİK had become registered and recognized in Turkey.
Another indication for bad faith registration and use is that the disputed domain name is fully identical to the Complainant’s trademark BORÇELİK.”
The Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
