Fossil Files UDRP Complaint for Fossil.name Domain Name

Fossil has recently filed a UDRP complaint at the National Arbitration Forum, asserting legal rights over Fossil.name domain name .

Fossil owns many trademark registrations for the “Fossil” mark all over the world. Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark.

Fossil filed the complaint with the National Arbitration Forum in November 2013.

The National Arbitration Forum will examine if the domain name is confusingly similar to the trademarked name. Moreover,it will examine if the owner of the disputed domain name has rights over it and if the domain is being used in bad faith. The domain name will be passed over to Microsoft if it falls under all three of these stipulations.

The case is still pending compliance checks with the National Arbitration Forum .
