Standard & Poor’s Loses Domain Name Case

Standard & Poor’s has lost a UDRP against the domain BoycottStandardandPoors.com at World Intellectual Property Organization (WIPO).

 

The Panel denied Standard & Poor’s request to transfer the domain name,considering that the domain name owner registered the domain in 2011 and hasn’t done anything with it .

“As Respondent conceivably could use the domain name at issue in a manner that would not constitute bad faith registration and use, and as the domain name at issue has yet to be used to resolve to a web site, Complainant has failed to establish that Respondent has no rights or legitimate interests in respect of the domain name at issue.”

Moreover,the Panel also decided that the domain name was not registered and used in bad faith,saying that Standard & Poor’s can file another complaint if the domain name owner will use the domain in bad faith.
