eBay Wins UDRP Case Covering Over 1,000 Domain Names Containing its Trademark

eBay has recently won a UDRP case, covering over 1,000 domain names containing its trademark.

eBay filed a compalint against the owner of 1,153 eBay-related .COM and .Net domain names. All the domain names included in the complaint contained its trademark and a series of numbers.

According to whois records, the domain names were all registered over two days ,last year.

eBAY owns many trademark registrations for the “eBay” mark all over the world. Therefore,it is more than obvious that the disputed domain names are confusingly similar to its trademark. Moreover, the company managed to demonstrate that the respondent has no rights or legitimate interest in the disputed domain names and that the respondent used the domain names in bad faith .

The arbitrator assigned to the case ruled in favor of eBay,indicating that the company has full rights to the disputed domain names .The respondent’s loss was also partly due to the fact that he failed to submit a response in this proceeding ,accepting these way eBay’s allegations as fact .
